A Legal Disclaimer

These Terms and Conditions govern the provision of services by OmniWorx. By requesting or accepting any services from OmniWorx, you agree to these terms. This document was informed by commonly used handyman service templates and contract practices to ensure clarity and completeness

Services and Estimates

  • Scope of Services: OmniWorx provides handyman, window cleaning, gutter cleaning, pressure washing, painting, landscaping, and holiday light installation services.

  • Estimates: Estimates are provided based on site inspection, photos, or customer descriptions. Estimates are valid for the period stated on the estimate or for 30 days if no period is specified.

  • Changes to Scope: Additional work or materials not included in the original estimate will be quoted separately and must be approved in writing before work proceeds.

Payment Scheduling and Access

  • Payment Terms: A deposit may be required before work begins. Final payment is due upon completion unless otherwise agreed in writing. Accepted payment methods will be specified on the invoice.

  • Late Payments: Late fees or interest may apply to overdue invoices at the rate shown on the invoice or the maximum rate allowed by law.

  • Site Access: You must provide safe access to the property for OmniWorx personnel. If access is delayed or denied, additional charges for rescheduling may apply. You are responsible for removing fragile or valuable items from the work area prior to service.

Liability Insurance and Warranties

  • Insurance: OmniWorx maintains general liability insurance for covered services. Proof of insurance is available upon request.

  • Warranties: Workmanship warranty terms, if any, will be specified in the written service agreement or invoice. Material warranties are provided by the manufacturers and are separate from OmniWorx warranties.

  • Limitations of Liability: To the fullest extent permitted by law, OmniWorx’s liability for claims arising from services is limited to the total fees paid by the customer for the specific work giving rise to the claim. OmniWorx is not liable for consequential, incidental, or punitive damages.

Cancellations Changes and Site Conditions

  • Customer Cancellations: Customers may cancel or reschedule no later than 2 weeks before scheduled service. A 25% fee will be charged for short-notice cancellations. Additional and/or incremental fees may apply.

  • Unforeseen Conditions: If unforeseen conditions are discovered (hidden damage, pest infestation, hazardous materials), OmniWorx will notify you, provide options, and quote any required additional work. Work will not proceed on additional items without your approval.

  • Permits and Regulations: Customers are responsible for obtaining any permits or approvals required by local authorities unless otherwise agreed in writing.

Dispute Resolution Governing Law and Privacy

  • Dispute Resolution: Parties will first attempt to resolve disputes informally. If unresolved, disputes will be resolved by binding arbitration or in the courts specified in the written agreement.

  • Governing Law: These Terms are governed by the laws of the state where the service is performed.

  • Privacy: Personal information collected for service delivery will be handled according to OmniWorx’s Privacy Policy.
